This is a single, combined document. It is the Privacy Policy, the Terms and Conditions, and the Student Data Protection Agreement for Insights App, LLC — everything below applies to all three.

These Terms and Conditions (“Terms”) govern access to and use of the Insights App educational platform (the “Service”) provided by Insights App, LLC (“Company,” “we,” “us,” or “our”).
The Service may be accessed through approved educational marketplaces such as Clever or directly through Insights App, LLC.
By purchasing, accessing, or using the Service, the educational institution (“Customer,” “School,” or “District”) agrees to these Terms. Where an individual educator creates an account directly rather than through a School or District, that individual is the Customer for purposes of these Terms and accepts them on their own behalf. The Service is not offered directly to students; a student may access the Service only through an account provided by their School, District, or supervising educator.
1.Description of the Service
Insights App is an educational technology platform designed to support teaching, learning, and instructional decision-making through digital tools, learning analytics, and AI-supported educational tools.
The platform may include:
- digital instructional modules
- online coursework and frameworks
- assignments and assessments
- engagement tracking and analytics
- teacher, student, and administrator dashboards
- AI-supported instructional insights
- communication and classroom tools
The platform includes proprietary and patent-pending technology developed by Insights App, LLC.
Insights App, LLC may update or improve the Service periodically to maintain performance, security, and functionality.
2.License to Use the Platform
Upon purchase or authorized access, Insights App, LLC grants the Customer a limited, non-exclusive, non-transferable license to use the Service for educational purposes during the active subscription period.
This license allows:
- teachers to use the platform for instruction
- students to participate through authorized accounts
- school administrators to access analytics and reporting
This license does not transfer ownership of the platform or its intellectual property.
3.Intellectual Property
All rights, title, and interest in the Service remain the exclusive property of Insights App, LLC.
This includes but is not limited to:
- software code
- AI models and algorithms
- analytics systems
- platform architecture
- educational content
- system designs and branding
- patent-pending technologies
Schools, districts, educators, and users may not:
- copy the software
- reverse engineer the platform
- extract algorithms or analytics systems
- create derivative technologies
- redistribute platform content outside authorized educational use
Use of the platform does not grant any ownership rights in the Company’s intellectual property. Any improvements, enhancements, or modifications to the Insights platform, technology, or adaptive learning systems made during the course of the Customer’s use of the Service shall remain the sole property of Insights App, LLC.
4.Student Data Privacy
Insights App, LLC is committed to protecting student information and maintaining compliance with applicable student privacy laws.
The platform operates in accordance with:
- Family Educational Rights and Privacy Act (FERPA)
- Children’s Online Privacy Protection Act (COPPA) where applicable
- applicable state student data protection laws
Insights App maintains a written information security program and a written data retention and deletion policy, published as Section 8 of this document. Where the Children’s Online Privacy Protection Act applies, Insights App relies on the School or District to provide consent on behalf of parents for the collection and use of student information for school-authorized educational purposes. Insights App does not disclose student information to any third party for any purpose other than providing the Service, and will not do so without separate verifiable consent.
When processing student information, Insights App acts as a school official with legitimate educational interest under FERPA.
Student data is used solely for the purpose of delivering the educational services requested by the school or district.
Insights App does not sell or rent student data and does not use student data for advertising.
5.Types of Data Collected
The Service may process limited educational information necessary to operate the platform.
Examples include:
Student Data
- student identifiers or names
- assignment submissions
- assessment results
- course participation
- engagement metrics
Institutional Data
- educator accounts
- classroom rosters
- course structures
Technical Data
- browser type
- device type
- system usage logs
Insights App follows data minimization practices and collects only information necessary to operate the Service.
6.Ownership of Educational Data
All student and institutional data generated through use of the platform remains the property of the School or District.
Insights App, LLC acts solely as a service provider and data processor.
The Company does not claim ownership of educational data created by schools.
7.School Data Access
Schools and districts may request access to their data at any time.
Upon written request from an authorized administrator:
- Insights App will provide a copy of the requested data
- in a standard electronic format
- within thirty (30) days
8.Data Retention and Deletion
Insights App maintains strict student data retention policies.
If a contract expires, is terminated, or is not renewed:
The School or District may request a complete export of its institutional and student data by written request from an authorized administrator, made at any time before the contract ends or within thirty (30) days after it ends. Insights App will provide that export in a standard electronic format within thirty (30) days of the request.
Student data will be permanently deleted within three (3) days after the earlier of (a) delivery of the requested export, or (b) the close of the thirty (30) day request window, unless the School or District directs otherwise in writing.
Once deleted, the Company will not retain recoverable copies of student data except where required by law or where a copy remains temporarily within routine, encrypted system backups. Backup copies are not used in the ordinary operation of the Service, are overwritten on a rolling schedule, and are permanently expunged within seven (7) days of deletion.
9.Data Security
Insights App maintains reasonable technical and administrative safeguards to protect educational information.
Security practices include:
- encrypted data transmission (HTTPS)
- restricted administrative access
- role-based permissions
- infrastructure monitoring
- system maintenance and security updates
These safeguards are designed to prevent unauthorized access or disclosure.
10.Third-Party Infrastructure
Insights App may utilize secure third-party infrastructure providers to host or maintain the platform.
These providers are required to maintain appropriate data protection standards and may process data only as necessary to support the Service.
Student data will never be sold to third parties.
11.Data Breach Notification
If a confirmed data breach affecting student or institutional data occurs, Insights App, LLC will notify the affected school or district without unreasonable delay and cooperate in remediation efforts.
12.Artificial Intelligence Transparency
The platform may include AI-supported features that assist educators by analyzing patterns in coursework and student engagement.
These tools are designed to support educators and enhance instructional insight, but they do not replace teacher judgment.
The AI components of the platform utilize proprietary and patent-pending technologies owned by Insights App, LLC.
Human Oversight
All instructional decisions remain under the authority of teachers and school administrators.
AI outputs are informational tools intended to assist educators.
No Automated High-Stakes Decisions
Insights App does not use AI to make automated high-stakes decisions regarding students, including:
- grading outcomes
- disciplinary actions
- learning diagnosis
- academic placement decisions
- eligibility determinations
13.No Student Profiling
Insights App, LLC does not create behavioral, psychological, or commercial profiles of students for non-educational purposes.
Student data is used only to support the educational services requested by the school or district.
The platform does not use student information for advertising, marketing, or commercial targeting.
14.AI Model Protection and No Model Training
Customer institutions and users may not use the platform or its outputs to train external artificial intelligence systems or develop competing technologies.
Users may not:
- extract training data from the platform
- use platform outputs to train machine learning systems
- attempt to replicate or reverse engineer AI models
- scrape or harvest platform data for model training
All AI systems and analytics technologies remain the exclusive intellectual property of Insights App, LLC.
15.Acceptable Use
Customers agree not to:
- misuse student data
- attempt unauthorized access to systems
- interfere with platform functionality
- extract proprietary technologies
The Company reserves the right to suspend access if these Terms are violated.
16.Limitation of Liability
To the fullest extent permitted by law, Insights App, LLC shall not be liable for:
- indirect or consequential damages
- decisions made by educators based on platform analytics
- interruptions caused by maintenance or external infrastructure disruptions
Total liability shall not exceed the amount paid by the Customer for the Service during the previous twelve months.
17.Modifications
Insights App may update these Terms periodically.
Updated Terms will be posted on the Company website and become effective upon publication.
Continued use of the Service constitutes acceptance of the updated Terms.
These Terms as published on the Company website at theinsightsapp.com are the operative version. Where a School or District has executed a separate written agreement with Insights App, LLC, that agreement controls as to that School or District to the extent of any conflict with these Terms.
18.Governing Law
These Terms shall be governed by the laws of the United States and the State of Delaware, without regard to its conflict of laws rules.
19.Google Sign-In and Google User Data
Insights App offers Google Sign-In as one method of accessing the Service. This section describes what Google account information Insights App receives, how that information is used, where it is stored, and with whom it is shared.
Information received
When a user chooses to sign in with Google, Insights App requests only Google’s basic sign-in scopes (openid, email, and profile). Through those scopes Insights App receives the user’s Google account identifier, email address, email verification status, display name, and profile picture address. Insights App does not request, and cannot access, any other Google service, including Gmail, Google Drive, Google Calendar, and Google Classroom.
Use of the information
Google account information is used only to authenticate the user, to create and identify that user’s Insights App account, and to display the user’s name within the Service. Insights App does not use Google user data for advertising, marketing, or commercial targeting, and does not use it to train artificial intelligence or machine learning models.
Storage of the information
Google account information is transmitted only over encrypted connections and stored in the Service’s authentication database, hosted by Insights App’s infrastructure provider on servers located in the United States. Of the information Google provides, only the email address and display name are copied into the user’s Insights App account record. Each sign-in is recorded in an access log retaining the date and time, the account, the sign-in method, the network address, and the browser identification, for security monitoring and audit purposes.
Sharing of the information
Insights App does not sell, rent, or trade Google user data. It is disclosed only to the infrastructure providers that host the Service, which process it solely on Insights App’s instructions and under contractual data protection obligations, or where disclosure is required by law.
Limited use
Insights App’s use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.
Withdrawing access and requesting deletion
A user may withdraw Insights App’s access to their Google account at any time through their Google Account permissions page. A user, or an authorized administrator acting on that user’s behalf, may request deletion of their Insights App account and the associated Google account information by contacting Insights App at the addresses in Section 20. Insights App will complete the deletion within thirty (30) days of a verified request, except where retention is required by law. Deletion of student data on expiration or termination of a School or District contract is governed by Section 8.
